A CMR consignment note should contain the detailed description of the goods, their quantity and/or gross weight or volume as well as conditions of transport.

An initial trial run using this consignment note took place on 25 July 2006 in Donetsk and Nizhnedneprovsk to destination stations in Germany.

As far as other modes of transport are concerned, the question of negotiability does not arise since non-negotiable transport documents, such as "consignment notes", are normally used.

Numerous lawsuits arise as the result of defects, including the illegibility of reservations and dates in the particulars entered in the consignment note by drivers and consignees.

Over and above this, there is the question whether the sender has to acquiesce in the making out of an electronic consignment note.

The phrase "from the functional point of view, particularly so far as concerns the evidential value of the consignment note represented by those data" is taken from the 1999 COTIF.

The procedure used for the registration and treatment of data must be equivalent from the functional point of view, particularly so far as concerns the evidential value of the consignment note represented by those data".

This proposed Protocol would be intended to permit the utilisation of electronic data en lieu of paper-based consignment notes.

This memorandum aims to inform the Working Party on the appropriateness of undertaking the development of a protocol to the CMR authorising the utilisation of electronic data in place of paper-based consignment notes.
